 The City Council met in the Council Chambers at 6:30 p.m. for the Regular Meeting.  Present: Mayor Tammy Buffington; Council Members JoAnn Decker, Nicholas Baney, Trever Borchard, Deb Stamm; City Clerk Diane Rosenfelt; City Superintendent Tim Smith; City Attorney Tawna Holmstedt, Acting Sheriff Lucci (arrived at 6:36 p.m.).  Absent: Administrative Assistant Robyn Mathews.  Others Present: Trevor Horner, James Kraus, Kathy Swanson, Merrel Martin and Michael Hoback; AMGL CPA.
 Following the Pledge of Allegiance to the flag of the United States of America, Mayor Buffington called the meeting to order and stated that we follow the open meetings law, which is posted on the south wall by the main entrance.
 Mayor Tammy Buffington thanked all for coming to the meeting.
 Motions made in paraphrased form and passed unanimously were:
 •Motion to give Kostka’s at 704 A Street until July 1, 2025 to make visual improvements.
 •Motion to approve the 2023-2024 Audit as presented.
 •Motion to contact Doug Christiansen of Five Rule Planning and have them hold off on Resolution to Foreclose on 704 A Street until July 1, 2025.
 •Motion to have Five Rule Planning proceed with paperwork on Joanne Law property located at 214 and 216 11th Ave. East.
 •Motion to introduce Ordinance #2025-854:
 •AN ORDINANCE BY THE MAYOR AND COUNCIL OF THE CITY OF BENKELMAN, DUNDY COUNTY, NEBRASKA, AMENDING CERTAIN SECTIONS OF THE CITY’S ZONING CODE; REPEALING ALL CONFLICTING PROVISIONS HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
 •Motion to waive the three (3) readings of Ordinance #2025-854.
 •Motion to adopt Ordinance #2025-854.
 •Motion to introduce Ordinance #2025-856:
 •AN ORDINANCE BY THE MAYOR AND COUNCIL OF THE CITY BENKELMAN, DUNDY COUNTY, NEBRASKA, AMENDING THE OFFICIAL ZONING MAP TO REZONE CERTAIN PROPERTY FROM COMMERCIAL DISTRICT (C-1) TO RESIDENTIAL TRANSITIONAL DISTRICT (R-4); REPEALING ALL CONFLICTING ORDINANCES HEREWITH AND PROVIDING AN EFFECTIVE DATE.
 •Motion to adopt Ordinance #2025-856.
 Council member JoAnn Decker made a motion to pull out the bill from Dundy County Clerk for Emergency Management Fees in the amount of $20,363.50 for more clarification and approve the consent agenda, seconded by Nick Baney. Ayes:  Baney, Decker, Borchard, Stamm; nays: none. Motion passed.

 •Planning Commissions Minutes: Public Meeting was held and approved  rezoning request for lots 1 and 2, Block 1, 1st Addition to Benkelman, Dundy County, Nebraska from Commercial (C-1) to Residential Transitional District (R-4); Approved Merrel Martin permit to bring in a trailer house and remodel it at the corner of 9th and Chief Lot 6 Block 34 2nd Addition to Benkelman; Approved Arlene Stute’s building permit for a new shed at 715 Dakota St.
 •Motion to deny invoices from RVW in the amount of $1,141.00.
 •Motion to accept the Bricks Building for $1 from Daisy Ruiz if all paperwork is completed by April 18, 2025 by noon.
 •Motion to approve raises to Swimming Pool Passes as presented.
 •Motion to approve the Contract with Shelco Construction in the amount of $143,775.00.
 •Motion to approve Robyn Mathews as the City Clerk/Treasurer for the City of Benkelman.
 •Motion to approve Diane Rosenfelt as City Office Manager.

 •Council member Nick Baney made a motion to introduce Ordinance #2025-855:
 •AN ORDINANCE BY THE MAYOR AND COUNCIL OF THE CITY BENKELMAN, DUNDY COUNTY, NEBRASKA, AMENDING THE MUNICIPAL CODE TO ESTABLISH PARKING RESTRICTIONS; REPEALING ALL CONFLICTING PROVISIONS HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
 •Motion was seconded by JoAnn Decker.  Ayes:  Borchard, Baney, Decker; abstain:  Stamm; nays:  none.  Motion passed.
 •Council member Nick Baney made a motion to waive the three (3) readings of Ordinance #2025-855, seconded by Trever Borchard.  Ayes: Baney, Decker, Borchard; abstain:  Stamm; nays: none. Motion passed.

 •James Kraus on storage containers in the residential area.
 •Kathy Swanson wants additional time for repairs/remodel for 704 A Street.
 •Acting Sheriff Lucci gave monthly Dundy County Sheriff Report.
 •Trevor Horner representing CRA.
 •Michael Hoback CPA from AMGL on 2023-2024 Audit.
 •City Clerk/Treasurer Diane Rosenfelt monthly report.
 •City Superintendent Tim Smith monthly report.
