DEED OF TRUST SECOND NOTICE OF DEFAULT
COMES NOW Jon S. Schroeder, Nebraska Bar #17793, and whose address is P.O. Box 4, Curtis, Nebraska 69025, Trustee under a certain Deed of Trust, and files this Second Notice of Default pursuant to NEB. REV. STAT. §76-1006: 1. The name of the Trustor is Ryan King, whose mailing address is P.O. Box 457, Trenton, NE 69044. The Trustee is Jon S. Schroeder and the Beneficiary is William Joe Davis, Judy Kay McDonald, Patsy Lee Schmitt, Wanda Jean Connely, James Dean Davis, Ryan Anthony Powers and Adam Michael Powers, as tenants in common, whose mailing address is 4311 Cripple Creek Road, Lincoln, NE 68516. 2. That the Deed of Trust was dated June 17, 2016 and recorded on June 23, 2016 at Book 101 of Mortgages on Page 816 in the Office of the Hitchcock County Register of Deeds. 3. The real property secured by said Deed of Trust is a parcel located in Hitchcock County in the SW1/4SE1/4 of Section 35, Township Three North, Range 33 described as Parcel ID: 440008182 in the Hitchcock County Assessor records as conveyed in Warranty Deed recorded June 23, 2016 at Book 72 of Deeds on Page 587 in the Office of the Hitchcock County Register of Deeds (“the real property”). 4. That a breach of an obligation for which this trust property was conveyed has occurred in that the Trustor has failed to do the following: a. Pay when due the principal and the interest on, the indebtedness evidenced by the Note, charges, fees and all other sums as provided in the Loan Instruments. b. Maintain fire and extended coverage insurance insuring the improvements and buildings constituting part of the real property for an amount no less than the amount of the unpaid principal balance of the Note (co-insurance not exceeding 80% permitted). The Trustor has failed to give notice to the Beneficiary of the insurance company for the insurance maintained by Trustor on the real estate as required by law. 5. The unpaid principal sum secured by the Deed of Trust is $52,556.69 as of October 1, 2025 together with the interest that is accruing. 6. The interest accrued on the unpaid principal sum including the day of the filing of this Notice of Default is $1,249.92. 7. The dollar amount of the per diem interest accruing from and after the date of recording of this Notice of Default is $20.16. 8. That Trustors may cure this default within 30 days from the date of the recording of this Notice of Default by complying with the following: a. Pay the accelerated balance of the Promissory Note in the amount of $53,806.61 as of December 2, 2025 and the additional interest on the indebtedness evidenced by the Note, charges, fees, attorney fees and all other sums as provided in the Loan Instruments. b. Maintain and send to Beneficiary proof of fire and extended coverage insurance insuring the improvements and buildings constituting part of the real property for an amount no less than the amount of the unpaid principal balance of the Note (co-insurance not exceeding 80% permitted). Such insurance policy shall contain a standard mortgage clause in favor of Beneficiary and shall not be cancellable, terminable or modifiable without ten (10) days prior written notice to Beneficiary. 9. Failure of the Trustor to cure this default by the payment of the accelerated balance due shall cause the property to be sold to satisfy the obligation of the Trustor.
